• Material Procurement: Sourcing and coordinating material deliveries
• Inspection Coordination: Scheduling and managing required inspections
• Subcontractor Communication: Facilitating communication between parties
• Design Consultation: Interior design and architectural planning support

We work in collaboration with licensed general contractors or provide coordination support for self-managed builds. All construction work must be performed by properly licensed contractors.

Service Limitations and Requirements

Funding Requirements

We currently only provide services to clients with funds readily available. We do not offer financing, loans, or payment plans. Full project funding must be secured before service commencement.

Licensing Compliance

All construction work must be performed by appropriately licensed contractors in accordance with Florida state and local regulations. We will not coordinate unlicensed construction activities.

Service Area

Our services are primarily available in Cape Coral, Florida, and surrounding Southwest Florida areas. Service availability outside this area is subject to evaluation and approval.

Client Responsibilities

As our client, you agree to:

• Provide accurate and complete project information
• Secure necessary funding before project commencement
• Obtain required property rights and permissions
• Comply with all applicable laws and regulations
• Maintain adequate insurance coverage for your project
• Make timely decisions when required for project progression
• Pay fees according to agreed schedules
• Communicate changes or concerns promptly

Payment Terms

• Coordination fees are due according to agreed payment schedules
• Late payments may incur additional charges
• Client is responsible for all third-party costs (contractors, materials, permits)
• Refunds are subject to the terms of individual service agreements
• All payments must be made in US dollars

Liability and Insurance

Limitation of Liability

Cape Coral Custom Build's liability is limited to coordination services only. We are not responsible for:

• Construction defects or workmanship issues
• Contractor performance or delays
• Material defects or delivery issues
• Permit denials or regulatory changes
• Weather-related delays
• Cost overruns beyond our coordination services

Insurance Requirements

Clients must maintain appropriate insurance coverage for their projects. Licensed contractors must carry required liability and workers' compensation insurance. We recommend consulting with insurance professionals regarding coverage needs.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Cape Coral Custom Build or our licensors. Design plans and project coordination materials created for clients remain the property of the respective parties as specified in individual service agreements.

Privacy and Confidentiality

We respect client privacy and maintain confidentiality of project information. However, we may use project images and general information (without personal details) for marketing purposes unless specifically prohibited by written agreement. Termination

Either party may terminate services with written notice as specified in individual service agreements. Termination does not relieve either party of obligations incurred prior to termination. We reserve the right to terminate services immediately for non-payment, breach of terms, or illegal activities.

Warranties and Disclaimers

Our coordination services are provided "as is" without warranties beyond those required by law. We make no warranties regarding:

• Project completion times or costs
• Contractor performance
• Permit approval outcomes
• Market conditions affecting materials or labor
• Third-party service quality

Dispute Resolution

Any disputes arising from our services will be resolved through binding arbitration in Lee County, Florida, under Florida law. Both parties agree to attempt mediation before pursuing arbitration.

Governing Law

These Terms are governed by the laws of the State of Florida. Any legal proceedings must be conducted in Lee County, Florida.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Continued use of our services constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
